Terms and conditions for congress participants

These general terms and conditions are divided into two parts:

Part A refers to the general terms and conditions of the German Association for Psychiatry, Psychotherapy and Psychosomatics (DGPPN) (hereinafter: Organiser) for the purchase of congress and event tickets for parts of the digital DGPPN Congress for which m:con – mannheim:congress GmbH (hereinafter: m:con) is acting as an agent; so-called scientific part of the event.

Part B refers to the general terms and conditions for the purchase of congress and event tickets for parts of the digital DGPPN Congressfor which m:con – mannheim:congress GmbH (hereinafter: m:con) is acting on its own behalfso-called non-scientific part of the event.

Part A

I. Scope

The following terms and conditions of the Organiser apply to contracts for the purchase of congress and event tickets (admission tickets) concluded between the purchaser of congress and/or event tickets (Customer) and the Organiser and entitle the holder to participate in the digital DGPPN Congress.

Customer confirmations to the contrary based on the Customer’s own terms and conditions or conditions of purchase are hereby rejected. Deviations from the general terms and conditions are only effective if they have been confirmed in writing by the DGPPN.

In justified exceptional cases, registration is also possible in written form (fax, e-mail, letter), in which case the general terms and conditions are also binding. For further event-specific terms and conditions of participation, please refer to the congress website.

This section does not apply to the purchase of admission tickets by exhibitors. In this case, the general terms and conditions for the purchase of congress and event tickets for events/parts of events for which m:con is acting on its own behalf will apply (see Part B).

II. Conclusion of contract

By sending his/her registration, the Customer places a binding order (offer) and declares himself/herself bound to the offer for five working days. Within this acceptance period, the information received will be checked. If the offer is rejected, the Customer will be notified. If the offer is accepted, an order confirmation/invoice will be sent. In the event that the information is incomplete or necessary information is missing, e.g. proof of the eligibility for a reduced rate, a request for additional information will be sent.

If it becomes apparent that the eligibility for the reduced rate ceases to exist or subsequently changes, both parties are entitled to request an adjustment.

Congress participants actively involved in the scientific programme (presenters/speakers) are generally not exempt from the congress fee. The same terms and conditions of participation apply to them as to congress participants (Customers) who are not actively participating in the scientific programme. The registration fees are linked to the corresponding professional category (see Registration Fees).

In the present case, the Organiser is the direct contractual partner of the Customer. m:con is not the organiser. m:con is acting on behalf of the Organiser. Contractual relationships with regard to the event are therefore established directly between the Customer and the DGPPN, unless m:con is expressly designated as the contractual partner in individual cases.

One such individual case is registration as an exhibitor. Here, a direct contract is concluded between m:con and the exhibitor. In this case, the general terms and conditions apply for the purchase of congress and event tickets for events/parts of events for which m:con is acting on its own behalf. These can be viewed below in “Part B”.

III. Types of payment

Payment can be made by SOFORT (online) bank transfer, SEPA Direct Debit or advance payment by bank transfer (up to two weeks before the start of the congress). Payment by bank transfer is no longer possible from two weeks before the start of the congress. From this point on, payment by credit card (American Express, Mastercard and Visa) is also available.

If paying by SOFORT bank transfer, SEPA Direct Debit or credit card, the total price of the order, including any additional fees, is due for payment immediately after conclusion of the contract.

By way of derogation, if payment is made by bank transfer the total price must be transferred in full to the account specified in the invoice by the date given in the invoice and must refer to the invoice number. The Customer must ensure that the final amount of his/her order can be posted in full, i.e. any bank and/or transfer fees incurred must be borne by the Customer. The information required for the bank transfer (invoice number, bank details) will be provided in the invoice. The invoice will be sent by e-mail.

Payment by credit card is possible from two weeks before the start of the congress.

Payments made by SEPA Direct Debit and credit card will be processed by the payment service provider Computop Wirtschaftsinformatik GmbH, Schwarzenbergstr. 4, 96050 Bamberg, Germany.

Payments made by SOFORT bank transfer will be processed by the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, Germany (hereinafter “SOFORT”). Sofort GmbH is part of the Klarna Group (Klarna Bank AB (publ.), Sveavägen 46, 11134 Stockholm, Sweden).

In accordance with Section 4, Para. 22 a) of the German Value Added Tax Act, the total congress registration fees shown are exempt from VAT.

IV. Cancellation policy

If the Customer is a business owner within the meaning of Section 14 of the German Civil Code and wishes to withdraw from the contract, the provisions on cancellation specified in Section V will apply.

If the Customer is a consumer within the meaning of Section 13 of the German Civil Code, the following cancellation policy will apply:

Right to cancel

You have the right to cancel this contract within fourteen days without giving reasons. The cancellation period is fourteen days from the date of conclusion of the contract.

by means of an unequivocal statement about your decision to cancel this contract. You may use our ready-made sample cancellation form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient if you to send the notification that you are exercising your right to cancel by the end of the cancellation period.

Consequences of cancellation

If you cancel this contract, without delay and at the latest within fourteen days of the day on which we receive notification of your cancellation of this contract we will refund you all payments that we have received from you. We will use the same means of payment for this refund as you used for the original transaction, unless something else has been expressly agreed otherwise with you. Under no circumstances will you be charged for this refund.

Exclusion of the right to cancel

According to Section 312g paragraph (2) S.1 of the German Civil Code, there is no right to cancel or the right to cancel expires prematurely in the following contracts:

Contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transport of goods, motor vehicle rental, delivery of food and beverages and for the provision of other services in connection with leisure activities, if the contract provides for a specific date or period for the provision of such services, Section 312g paragraph (2) S.1 No. 9 German Civil Code. Example: Order for admission tickets for events on a specific date.

V. Cancellations

Irrespective of the provisions specified under IV, you have a contractual right to cancel an order. Cancellations must be made in writing and should be addressed to:

On receipt of the cancellation by 31st August 2020 by m:con registration management, the cancellation is free of charge and your participation fee will be refunded. From 01st September 2020 the cancellation is possible with deduction of a 25% cancellation/handling fee. In the event of cancellation of your bookings (congress fee, workshop fees if applicable) after 01st October 2020, no refund is possible and the full fee is due even if the invoice has not been paid yet. Nomination of a substitute participant who will pay the booked registration fee is also possible. The full participation fee is also payable if a registered participant fails to participate in the congress. As a presenter, if your submission is rejected, cancellation is possible free of charge until 31st August. In this case no cancellation/handling fee will be charged. For submitters of e-posters, if your e-poster is rejected, there is an extended cancellation period free of charge until 21st September 2020.

If the Customer is a consumer within the meaning of Section 13 of the German Civil Code and exercises his/her right to cancel within the cancellation period to which he/she is entitled pursuant to IV, no processing fee will be due.

VI. Changes/Cancellations/Loss

If it is impossible to hold the congress due to a force majeure, the DGPPN may cancel the congress. Force majeure includes official orders, strikes, civil unrest, war or threat of war, threatened or actual terrorist attacks, epidemics, natural disasters, significant disruption to or other emergencies that make holding the congress impossible or pointless. The prerequisite for cancellation is that the force majeure occurs within 30 days before the start of the Congress or it is expected that the consequences will continue to have an effect at the time of the congress.

In this case, paid registration fees will not be refunded. The DGPPN is also not obliged to reimburse the participant for payments or deposits already made to third parties (such as hotel bookings).

Necessary, short-term programme changes cannot be ruled out. The Organiser reserves the right to replace speakers; relocate, reschedule or cancel individual events; and make changes to the programme.

No registration fees for cancelled lectures or changes to the programme can be refunded, not even in part.

VII. Liability

The DGPPN and m:con are liable – regardless of the legal basis – only for damages that are due to intentional or grossly negligent breaches of duty. The DGPPN and m:con are also liable for damages resulting from injury to life, body or health in the case of slightly negligent breaches of duty.

In the event of a breach of material contractual obligations, the liability of the DGPPN and m:con is limited to the foreseeable damage typical for the contract, unless there is intent or gross negligence or liability for injury to life, body or health.

The above exclusions and limitations of liability also apply to breaches of duty by organs and vicarious agents of the Organiser and m:con.

VIII. Data protection policy

m:con is a company that specialises, among other things, in the planning, organisation and execution of events of all kinds, in particular congresses (medical-scientific), (scientific) conferences, general meetings, trade fairs, exhibitions, seminars, training events and other commercial events. The events are held at the Congress Center Rosengarten Mannheim or other venues by m:con itself or as a service provider for other organisers.

m:con uses customer management software to process the data collected during the registration process, which may also be personal data, for the purposes of (i) fulfilling the contract, (ii) maintaining customer or business relations, (iii) documenting these relations, (iv) complaint and quality management and (v) direct advertising, after separate declaration of consent, to send customers information about and offers of events that are being held or managed by m:con. By submitting a contribution to the congress, you also agree to the storage, processing and use of your personal data as required for this purpose. If a submitted contribution is accepted, some personal data (first name, last name, location) will be published in the online programme.

The legal basis of this data processing is Article 6 (1), a, b, f of the European General Data Protection Regulation. Data are always processed in relation to the specifically stated purposes.

When data are collected, extensive precautions will be taken to protect your personal data. Your data will be treated as strictly confidential, stored in a secure environment and protected from unauthorised access. Only authorised employees will have access to your data.

IX. Digital DGPPN Congress 2020

IX a. Livestream

The DGPPN Congress 2020 will be held as a digital event. From 26th to 28th November 2020, the congress will be broadcast as a livestream on the platform of a third-party provider. The live transmission of the lectures requires that agreements are concluded in advance with all actively involved speakers.

IX b. Technical issues related to the livestream

After registering for the congress and signing up on the streaming platform, congress participants who are not actively involved in the congress programme can watch the livestream on the streaming platform. To allow CME points to be awarded, in accordance with the requirements of the Berlin Chamber of Physicians participants’ online presence will be documented via tracking. A chat tool will allow the audience to directly and actively participate, e.g. in the discussions after the lectures.

Congress participants with an active role in the congress programme (including speakers) can join their respective meeting via Zoom (see additional data protection declaration for Zoom).

IX c. Third-party providers for the digital DGPPN Congress 2020

In addition to m:con, the following third-party providers have been commissioned to implement the digital DGPPN Congress 2020:

Congress preparation/lecture recording/digital setting up of meetings/support of live sessions: ESTENSIS GmbH (link to data protection declaration: https://estensis.de/datenschutzerklaerung/).

Streaming platform/livestream/supervision of the livestream: meta-fusion GmbH (link to data protection declaration: https://www.meta-fusion.com/privacy-policy/). Meta-fusion will also integrate the chat tool Slido, which will enable interactive exchanges between participants and speakers/chairmen (link to data protection declaration: https://www.sli.do/terms#privacy-policy).

X. General terms and conditions for submission of contributions

Symposia
Symposia can be registered by a chairperson with a minimum of three and a maximum of four speakers. Chairs and speakers are not exempt from the registration fee. The registration fee is due upon registration of a scientific contribution. The Scientific Committee of the DGPPN reserves the right to not include in the congress programme contributions from speakers who have not paid the registration fee.

If the Scientific Committee does not include the contribution in the programme, congress participation can be cancelled free of charge until August 31 of any year. In this case, the full registration fee will be refunded.

If the speaker withdraws the contribution after it has been accepted by the Scientific Committee, the registration for the congress will remain valid. Cancellation of congress participation is possible according to the terms and conditions listed in paragraph V.

Mid-August, the congress office will inform contributors whether their submitted symposium will be included in the scientific programme of the congress. The participating speakers will be asked to register for the congress for a fee.

E-posters
Participants may submit contributions as e-posters. After submitting an e-poster, the speaker is obliged to present it at the digital congress if it is accepted into the congress programme and is not withdrawn by the speaker. A substitute presenter for a submitted e-poster is not provided for. Registration of an e-poster includes binding registration of the contributor to participate in the congress for a fee. The registration fee is due upon registration of a scientific contribution.

All contributors will be informed by the congress office in mid-september whether their contribution is to be included in the scientific programme of the congress. Please note that a contribution can only be included in the scientific programme once the registration fee has been paid into the congress bank account.

If the Scientific Committee rejects the e-poster, congress participation may be cancelled free of charge until September 21. In this case, the full registration fee will be refunded.

If the contributor withdraws the contribution after it has been accepted by the Scientific Committee, the congress registration will remain in effect. Cancellation of congress participation is possible under the terms and conditions listed in Section V.

Information about relationships with companies 
Every presenter and first author of an e-poster is obliged to submit a statement about any relationships with companies. This also applies to invited presenters. Every presenter is asked to inform the audience at the start of the presentation about relationships with companies. It is recommended that the presenter uses the DGPPPN PowerPoint slide for this purpose (see https://www.dgppnkongress.de/en/).

XI. Place of fulfilment and place of jurisdiction

The place of jurisdiction for all legal disputes arising from the contract will be Berlin if the contracting parties are merchants, legal entities under public law or special funds under public law or if at least one of the contracting parties has no general place of jurisdiction in the Federal Republic of Germany or if, after conclusion of the contract, the contracting party moves its domicile or usual place of residence outside the Federal Republic of Germany or if its domicile or personal residence is not known at the time of filing the action. The DGPPN is also entitled to take legal action at the Customer’s general place of jurisdiction. The place of fulfilment for all obligations arising from this contract is Berlin.

XII. Applicable law

The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on the International Sale of Goods.

XIII. Final provisions

Should one or more provisions of this contract be or become invalid in whole or in part, the remainder of the contract shall remain valid. Ineffective provisions shall be replaced by ones that come closest to the purpose intended by the parties.

In accordance with Directive 2013/11/EU, we would like to inform you that the EU Commission has set up an internet platform for the online settlement of disputes between businesses and consumers (“OS Platform”). You can access this platform at http://ec.europa.eu/consumers/odr.

These general terms and conditions are effective as of 23.09.2020.

Part B

General terms and conditions of m:con – mannheim:congress GmbH (hereinafter: m:con) for the purchase and sale of congress and event tickets for parts of the digital DGPPN Congress for which m:con is acting on its own behalf.

I. Scope

The following terms and conditions of m:con – mannheim:congress GmbH apply to contracts for the purchase or sale of congress and event tickets (admission tickets) concluded between the purchaser of congress and/or event tickets (Customer) and m:con and entitle the holder to participate in the digital DGPPN Congress.

Here, m:con is the organiser and therefore the direct contractual partner of the Customer.

Customer confirmations to the contrary on the basis of the Customer’s own terms and conditions or conditions of purchase are hereby rejected. Deviations from the terms and conditions of m:con are only effective if they have been confirmed in writing by m:con.

In justified exceptional cases, registration is also possible in written form (fax, e-mail, letter), in which case the general terms and conditions are also binding. For further event-specific terms and conditions of participation, please refer to the congress website.

In the latter case, the acceptance period shall be extended by a further five working days.

A direct contract will be concluded between m:con and the Customer.

III. Types of payment

Payment can be made by SOFORT (online) bank transfer, SEPA Direct Debit or advance payment by bank transfer (up to two weeks before the start of the congress). Payment by credit card (American Express, Mastercard and Visa) is also available from two weeks before the start of the congress.

If paying by SOFORT bank transfer, SEPA Direct Debit or credit card, the total price of the order, including any additional fees, is due for payment immediately after conclusion of the contract.

IV. Cancellation policy

If the Customer is a business owner within the meaning of Section 14 of the German Civil Code and wishes to withdraw from the contract, the provisions on cancellation specified in Section V will apply.

If the Customer is a consumer within the meaning of Section 13 of the German Civil Code, the following cancellation policy will apply:

Consequences of cancellation

If you cancel this contract, without delay and at the latest within fourteen days of the day on which we receive notification of your cancellation of this contract we will refund you all payments that we have received from you, including delivery costs (with the exception of any additional costs that arose because you chose a different type of delivery from the cheapest standard delivery offered by us). We will use the same means of payment for this refund as you used for the original transaction, unless something else has been expressly agreed with you. Under no circumstances will you be charged for this refund.

We may refuse to issue the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us without delay and in any event at the latest within fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the end of the fourteen-day period. You will bear the direct costs of returning the goods. You will only be liable for any loss of value of the goods if this loss of value is due to handling by you that is not necessary for testing the condition, properties and functionality of the goods.

Exclusion of the right to cancel

According to Section 312g paragraph (2) S.1 of the German Civil Code, there is no right to cancel or the right to cancel expires prematurely in the following contracts:

VI. Changes/Cancellations

The Organiser reserves the right to make necessary changes to the programme at short notice. Registration fees will not be refunded, also not in part, because of cancelled presentations or changes to the programme.

VII. Additional processing fees

Admissions tickets are personalised. A processing fee of EUR 10,- plus VAT will be charged per person for name changes.

In the event of corrections to the invoice, a processing fee of EUR 20,- plus VAT will be charged. Special requests regarding invoicing must be communicated when registering.

VIII. Liability

m:con is liable – regardless of the legal basis – only for damages that are due to intentional or grossly negligent breaches of duty. m:con is also liable for damages resulting from injury to life, body or health in the case of slightly negligent breaches of duty.

Meta-fusion will also integrate the chat tool Slido, which will enable interactive exchanges between participants and speakers/chairmen (link to data protection declaration: https://www.sli.do/terms#privacy-policy).

XI. Access to the exhibition and the industry symposia

In compliance with the German Medicines Advertising Act, the exhibition as well as the industry symposia are reserved exclusively for doctors, scientists and members of related professions.

XII. Place of fulfilment and place of jurisdiction

The place of jurisdiction for all legal disputes arising from the contract will be Berlin if the contracting parties are merchants, legal entities under public law or special funds under public law or if at least one of the contracting parties has no general place of jurisdiction in the Federal Republic of Germany or if, after conclusion of the contract, the contracting party moves its domicile or usual place of residence outside the Federal Republic of Germany or if its domicile or personal residence is not known at the time of filing the action. m:con is also entitled to take legal action at the Customer’s general place of jurisdiction. The place of fulfilment for all obligations arising from this contract is Berlin.

XIII. Applicable law

The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on the International Sale of Goods.

XIV. Final provisions

Should one or more provisions of this contract be or become invalid in whole or in part, the remainder of the contract shall remain valid. Ineffective provisions shall be replaced by ones that come closest to the purpose intended by the parties.

In accordance with Directive 2013/11/EU, we would like to inform you that the EU Commission has set up an internet platform for the online settlement of disputes between businesses and consumers (“OS Platform”). You can access this platform at http://ec.europa.eu/consumers/odr.

The Organiser is neither willing nor obliged to participate in dispute settlement procedures in front of a consumer arbitration board.

These general terms and conditions are effective as of 23.09.2020.

 

Data protection declaration for Zoom

Congress participants who are not actively contributing to the programme will watch the livestream and will not dial in via Zoom.

Purpose of the processing

Our service providers will use Zoom for the (technical) organisation of the digital DGPPN Congress 2020. Congress participants with an active role in the programme (speakers/chairpersons) will dial into their respective live sessions via Zoom and will be broadcast on the congress streaming platform. In this case, Zoom will be used as the carrier for the live broadcast. A personal Zoom account is not required. Speakers and chairpersons will dial into the respective session via a Zoom link.

Zoom is a service provided by Zoom Video Communications, Inc., which is based in the USA.

Which data will be processed?

When Zoom is used for the live sessions, the following personal data may be processed:

Information on the user (speaker/chairperson): first and last name; telephone number (optional); email address; password if using personal Zoom account (not applicable if user dials in via Zoom link and uses single sign-on); profile picture (optional); department (optional).

Meeting metadata: topic, description (optional), IP addresses of participants, information on devices/hardware being used by participants.

For recordings (optional): MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, text file of the online meeting chat.

When dialling in with a telephone: information on the incoming and outgoing telephone number, country name, start and end time. Additional connection data, such as the IP address of the device, may be saved.

Text, audio and video data: Participants may have the option to use chat, question or survey functions in an online meeting. In this case, the text entries made there will be processed so that they can be displayed in the online meeting and, if applicable, recorded. To enable the display of video and playback of audio, the data from the microphone and, if present, the video camera of the terminal device will be processed for the duration of the meeting. At any time, users can switch off the camera or mute the microphone themselves in Zoom.

To be able to participate in an online meeting or enter the meeting room, participants need to install the latest Zoom app and to provide their name upon request so that they can be quickly identified as a speaker or chairperson.

Scope of the processing

Our service providers will be using Zoom to implement the digital DGPPN Congress 2020. We do not intend to record the Zoom meeting(s) during the congress.

The content of chats will be recorded if the results of an online meeting have to be recorded. However, this will not usually be the case.
